1. Introduction
Welcome to The Australian Retirement Toolkit ("we", "us", "our"). The website is owned and operated by Barry Istuk as an individual/sole proprietor. We do not currently hold an Australian Business Number (ABN) and are not registered as a company. These Terms & Conditions govern your use of our website, calculators, workbooks and other resources ("the Service"). By accessing or using the Service, you agree to be bound by these terms. If you do not agree, please do not use the Service.
2. General information only
Everything on this site is general information and educational material. It is not personal financial, legal, tax, superannuation or estate planning advice. The tools and workbooks are designed to help you organise your thinking and records, not to recommend specific financial products or strategies.
Before making any decision that affects your financial, legal or personal situation, please consult a licensed Australian financial adviser, accountant, solicitor or other qualified professional.
3. Use of calculators and workbooks
Our calculators use assumptions that you can view and adjust. Outputs are estimates based on the inputs you provide and should not be treated as guarantees, projections or advice. We do not verify the accuracy of the figures you enter, and we are not responsible for decisions made based on calculator results.
4. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for any unlawful, fraudulent or misleading purpose;
- send spam or use the Service to harass others;
- infringe our intellectual property rights or those of any third party;
- attempt to interfere with the security or integrity of the Service, including introducing malware, probing for vulnerabilities, scraping, or circumventing technical or access controls;
- resell, redistribute or share purchased workbook files, download links or account credentials with anyone else.
5. Accounts and access
To access purchased workbooks you may need to create an account. You are responsible for keeping your login credentials confidential and for activity that occurs under your account. You agree to provide accurate information and to keep it up to date. We may suspend or terminate your access if you materially breach these terms, fail to pay, or if we reasonably believe your account is being used fraudulently or in a way that poses a security risk.
6. Intellectual property and licence
All content on this site — including text, images, calculators, workbook templates, logos and code — is owned by or licensed to us and is protected by Australian and international copyright laws. On purchase of a workbook, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use that workbook for your personal, non-commercial use. You may not reproduce, resell, redistribute, sublicense, publicly share or modify our materials without our prior written permission.
7. Payments and Merchant of Record (Paddle)
Our order process is conducted by our online reseller Paddle.com Market Ltd and its affiliates ("Paddle"). Paddle is the Merchant of Record for all our orders. Paddle provides all customer service enquiries in relation to the transaction and handles returns and refunds in accordance with its policies and applicable law.
By placing an order you also agree to Paddle's Checkout Buyer Terms, available at paddle.com/legal/checkout-buyer-terms, which govern the payment, billing, applicable taxes, cancellation and refund mechanics of your purchase. All prices are shown in Australian dollars (AUD) unless stated otherwise.
8. Refunds
Refund requests for Paddle transactions are handled through Paddle's buyer/order support process. Please see our Refund Policy for details, including our 30-day money-back guarantee and your consumer rights under Australian Consumer Law where applicable.
9. Service level and warranties
We work to keep the Service available and accurate but do not guarantee that it will be uninterrupted, error-free or free of security incidents. To the fullest extent permitted by law we exclude all implied warranties (including merchantability and fitness for a particular purpose). Nothing in these terms excludes rights or guarantees that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law.
10. External links
The site may link to government services, superannuation funds, financial institutions or other third-party websites. We do not control these sites and are not responsible for their content, accuracy, security or privacy practices. Visiting external sites is at your own risk.
11. Limitation of liability
To the fullest extent permitted by law, we exclude all liability for any loss, damage, cost or expense arising from your use of, or reliance on, the site or its contents. This includes indirect, consequential, special or incidental loss (such as loss of profits, data or goodwill). Where liability cannot be excluded, our total aggregate liability to you is limited to the amount you have paid for the relevant workbook in the 12 months before the claim arose. Nothing in this clause limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

13. Changes to these terms
We may update these Terms & Conditions from time to time. The latest version will always be posted on this page with the effective date noted below. Continued use of the site after changes means you accept the updated terms.
14. Governing law
These terms are governed by the laws of Western Australia, Australia. Any dispute arising from these terms or your use of the site will be subject to the exclusive jurisdiction of the courts of Western Australia.
